Deposit
A non-refundable deposit of $1000.00 is required for the purchase of the cat/kitten. The rest of the balance will be paid upon transport. Should the purchaser, after having paid the deposit, decide against purchasing the kitten, he or she forfeits the deposit. The kitten or cat will be reserved once the deposit is received. No kitten or cat will be held without the full deposit paid. The deposit amount will go toward the full price of the kitten/cat.
CATTERY VISITS NOT ALLOWED: Generally, for the safety and security of Cattery, cats/kittens and humans, Cattery visits are not allowed. For the safety and security of the buyer facetime visits are done by appointments. Buyer is responsible for all costs associated with delivery. The buyer understands that we will ship our kittens via pet nanny. The Breeder is not responsible for the cat/kitten during transportation and for the consequences of transportation for cat/kitten’s health.
Spay/Neuter:
This Maine Coon cat/kitten is registered with TICA and is sold as a pet/show. The kitten needs to be neutered (ASAP since this kitten is older)within 6 -month old for a male or female. Buyer will submit proof of cat being neutered to seller. Buyer will receive breeder slip upon completion of this step. Under no circumstance the kitten/cat can be used in breeding.
If the buyer fails to provide a spay/neutered statement for their kitten, the 1-year health guarantee is voided.
Under NO circumstances shall this kitten be de-clawed. Declawing is amputation and is often the cause of litter box problems (“inappropriate elimination”). This can lead to abuse or abandonment of the cat/kitten, a risk that the seller is not willing take. The purchaser agrees to, under no circumstances, allow the cat to be declawed.
Under NO circumstances shall this kitten/cat be permitted to live outdoors.
Under NO circumstances shall this kitten/cat be tattooed, pierced, or undergo any unnecessary "fashionable" body modification.
The new cat should be confined to a private room with toys, food, the kitten’s litter box, and plenty of human contact until accustomed to his/her new surroundings.
Buyer ensures that this kitten/cat will remain properly fed high quality cat food, groomed, vetted and loved for the entirety of its life.
NO REPRESENTATION AS TO FUTURE DEVELOPMENT OF KITTEN: Breeder makes no guarantee as to Kitten’s future development, color, pattern, coat type, size, weight, traits, temperament or future regarding suitability for show/exhibition. Although seller would love to guarantee all these attributes, this is a living organism and a cat’s development has too many factors to guarantee or even suggest an outcome.
Updates Required: This The buyer agrees to send updates regarding the kitten to include photos at least twice a year.
Professionalism: This The buyer agrees that in the event of a dispute they will remain professional and will settle with the breeder amicably. This includes slander on social media.
Home for cat/kitten:
Buyer agrees and understands that the kitten will be required to see a vet within 3 days of going home. If confirmation of veterinary exam is not received this may null and void the health guarantee provided by the breeder.
Buyer agrees to provide all necessary ongoing veterinary care for the kitten or cat.
Buyer is contracted to provide a lifetime home for the cat/kitten. Buyer will contact the breeder immediately if the Buyer is unable to keep this cat/kitten. Buyer agrees that if the cat/kitten is found to be neglected, mistreated including unsupervised outside time the Breeder shall have the unconditional right to reclaim the cat/kitten WITHOUT refund of purchase price.
Misrepresentation: Buyer agrees that if it is found that they misrepresented home or living conditions or are in fact purchasing a kitten for another party without disclosure to the breeder, the breeder has the right to ask the kitten to be returned at the buyer’s expense.
Buyer has the right to submit Kitten to a health check (at Buyer’s own expense) in a licensed veterinary practice. If, within 3 days of Acceptance of Kitten, a licensed veterinarian finds that Kitten is unfit for purchase due to a life threatening or untreatable illness, Buyer shall immediately deliver written proof of such illness to Breeder; such written proof must be issued and signed by licensed veterinarian and shall identify Kitten by physical description and microchip number as well as include a full explanation as to why Kitten is (in veterinarian’s opinion) unfit for purchase, and provide any documentation confirming diagnosis or opinion.
Kittens can become very stressed during moves to new environments, change of diet, and too much handling. Upon leaving Cattery, Kitten may show signs of stress, including, but not limited to sneezing, runny nose, watery eyes, and possible diarrhea or vomiting as Kitten’s immune system is still immature and may plummet during times of stress and transition. These symptoms, in and of themselves (devoid of other issues), do not render Kitten unfit for purchase nor do they warrant a return or exchange.
Kitten Health Guarantee:
There will be no declawing of the kitten.
The kitten/ cat is guaranteed to be FeLV & FIV negative on the date of the sale.
The cat/ kitten shall be isolated from other cats/ animals for a period of 7 days in a new home. The cat/ kitten shall be examined by a licensed veterinarian during this time.
This cat/kitten is guaranteed for 12 months from the date of purchase not to have any of the following genetic conditions: HD (Hip Dysplasia), HCM (Hypertrophic Cardiomyopathy), PKD (Polycystic Kidney Disease), and SMA (Spinal Muscular Atrophy)
If found to have one of the above-mentioned conditions; HD, HCM, PKD, or SMA, the Breeder shall be notified and the Buyer may be entitled to a refund equal to the total purchase price of the kitten. The total liability of the Breeder shall in no case exceed the total purchase price of the cat/ kitten.
If the cat/kitten should die from a genetic problem after sale within the first 12 months, the breeder shall either replace the kitten with one of equal quality or refund the purchase price/deposit. For replacement or refund, the owner must present certified autopsy results confirming the reason for death. The total liability of the breeder shall in no case exceed the total sale price of this contract.
LIMITED WARRANTY: If it is found that Kitten has an untreatable or life-threatening illness or defect within 3 days of acceptance, Breeder agrees to resume immediate ownership of Kitten (upon expedient return by Buyer as detailed below) and to provide Buyer with a replacement of a comparable Kitten. All transportation costs to return original Kitten back to Breeder, AND for replacement kitten to get back to Buyer, are the financial responsibility of Buyer.
Because Breeder has a limited number of Kittens per year and may be obligated to other Buyers, Breeder has up to 18 months to replace Kitten. Kitten will be replaced with another Kitten selected by Breeder, in Breeder’s sole and absolute discretion of equal value and gender of the initial kitten (Buyer may pay any upgrade difference if Buyer chooses a replacement kitten of a higher value). Breeder is not obligated to replace kitten with another kitten with the same type, color or pattern, but will attempt to do so when possible. There are times when Breeder may not have available replacement kittens and may work with another trusted Cattery to uphold all contractual obligations to replace kitten.
ADDITIONAL EXCLUSIONS & STIPULATIONS (which may not be mentioned above):
All warranties shall exclude illness or injury associated with improper transportation, improper maintenance, improper feeding, accidents (including but not limited to injuries by other pets, Kitten escaping to outside, poisoning, overheating or hypothermia due to being left in extreme temperatures, dehydration due to lack of water, swallowing an item not suitable for ingestion, injury in transit, etc.); even if such issues are not the direct fault of Buyer, if they happen once Buyer has Accepted Kitten and has thus assumed ownership, said issues shall be excluded from all warranties.
All warranties shall EXCLUDE minor and easily treatable medical conditions not known to either party at time of Acceptance of Kitten.
All warranties shall EXCLUDE viral, bacterial, parasitic or protozoal infections that are easily transmissible and present at large in many innocuous environments including surfaces at a groomer or veterinarian practice, cars or airplanes, tracked in on shoes or clothing from public places and sometimes unknowingly in Buyer’s own home. Presence of these minor issues shall not deem Kitten unfit for purchase. These infections can be contracted literally upon departing Cattery (and some viruses may be detected in Kitten’s system in low levels as recent immunization may generate antibodies. However, Kitten will be preventatively and broadly treated for such conditions prior to leaving Cattery AND in any case, these issues are rarely life threatening unless left untreated, and are categorically considered part of pet ownership. While FIV and FeLV are life threatening, these are specifically excluded since Kitten lives in Cattery known to be free of FeLV and FIV.
All warranties shall EXCLUDE veterinary or diagnostic bills incurred while Kitten is in Buyer’s possession. The ONLY compensation which Breeder shall make to Buyer in the event of a valid warranty claim is replacement of Kitten as per the terms stated above; Breeder shall at no time and under no circumstances be liable for more than the replacement of a Kitten.
Any veterinary diagnostic or treatment expenses incurred while Kitten is in care of Buyer, are the responsibility of Buyer only. There are no cash refunds or reimbursements and Breeder shall never be responsible to a third party for payment expenses incurred with Kitten is in Buyer’s care.
Breeder is not responsible for damage or injury to other animals, persons, or property caused directly or indirectly by their Kitten.
VETERINARY RECORDS SHALL BE MADE AVAILABLE TO BREEDER, ALL DOCUMENTS SHALL BEAR MICROCHIP NUMBER & BUYER SHALL MAKE KITTEN ACCESSIBLE FOR RE-EXAMINATION IN THE EVENT OF DISPUTE REGARDING HEALTH: For all health issues reported to Breeder including issues arising under warranties, Buyer hereby authorizes any and all veterinarians who have treated or examined Kitten at any time to release ALL medical records of Kitten regardless of date and nature of treatment, as well as authorizing said veterinarians to communicate with Breeder to discuss the same. On all documents submitted to Breeder for purposes of documenting sterilization or other issues under warranty, the issuing veterinarian shall specify the microchip number as well as a physical description of Kitten. If an issue is disputable, Breeder has the right to submit Kitten to re-inspection and evaluation by veterinarian of Breeder’s choice for a second opinion in which case Buyer shall expediently deliver kitten to veterinarian of Breeder’s choice within 50 miles from Buyer’s home.
BUYER AGREES TO KEEP CONFIDENTIAL ALL PROPRIETARY INFORMATION, CLAIMS & DISPUTES AMONG THE PARTIES: All information about the procedures or policies of Breeder or Cattery received as result of communication between Buyer and Breeder (written or verbal) shall remain confidential and shall not be transferred to third parties OR be covered in the media, Internet resources (including social media and information forums) or word of mouth, except for as required or permitted in a legal proceeding. Nor shall anyone else do this FOR Buyer since this information will not otherwise be available to others if Buyer abides by this clause. This includes providing a copy of Breeder’s Contract to others, and publicly expressing negative reviews, discussing warranty claims, etc. Conflict situations shall be resolved only between Buyer and Breeder, or in a court of law.
JURISDICTION & INTERPRETATION FOR LEGAL DISPUTES FOR ISSUES WHICH CANNOT BE RESOLVED BETWEEN THE PARTIES: If disputes should arise that cannot be resolved between the parties, legal jurisdiction shall be in Commonwealth of State of Georgia time of filing) and governing law shall be according to the Commonwealth of Georgia where Contract was signed and whether Kitten was shipped or delivered to another state.
The breeder reserves the right to cancel this transaction at any time prior to the kitten being received understanding that the reserve or deposit will be returned unless canceled due to misrepresentation or above items mentioned on this agreement.
Trupanion Free 30 day Insurance:
TaLynn King Coons has been able to secure a free month of pet insurance for all new buyers at zero cost through Trupanion. TaLynn King Coons does not receive any financial incentive from this partnership. Our goal is to 100% offer the best insurance coverage at an affordable price to our kitten’s forever home. If in the unlikely event that a kitten must go to the vet and incur substantial medical bills within the first 30 days, the seller will not be responsible for any veterinary cost.
Relinquishment of Ownership of Cat or Permanent Transfer of Cat by Purchaser
The purchaser agrees that under NO circumstances will the kitten/cat EVER be sold or given to a pet shop, animal shelter, research laboratory, or similar facility. Should the purchaser, for any reason, not be able to keep the above kitten, the seller will be given the first option of rescuing the cat.
If the buyer has a living trust, the previous clause must be made note of in the trust; if the seller deems another interested party (e.g., family member of buyer; close friend of buyer) a desirable and willing owner, the seller will seriously consider transferring ownership of aforementioned cat.
If the buyer decides that he or she no longer wants the cat, regardless how many years have passed since purchase of the cat/kitten, the seller will be given the first option of rescuing the cat.
